  8.  Non-Commercial distribution and/or use is permitted under the following
  9.  terms:

  12.  1. You may copy and distribute verbatim copies of BinkleyTerm source and
  13.  executable code as you receive it, in any medium, provided that you
  14.  conspicuously and appropriately publish on each copy a valid copyright
  15.  notice "Copyright (C) 1987, 1988, 1989 Robert Hartman and Vincent 
  16.  Perriello"; keep intact the notices on all files that refer to this 
  17.  License Agreement and to the absence of any warranty;  PROVIDE UNMODIFIED
  18.  COPIES OF THE DOCUMENTATION AS PROVIDED WITH THE PROGRAM; and give any 
  19.  other recipients of the BinkleyTerm program a copy of this License 
  20.  Agreement along with the program.  You may charge a distribution fee for
  21.  the physical act of transferring a copy, but no more than is necessary to
  22.  recover your actual costs incurred in the transfer. Under no
  23.  circumstances is BinkleyTerm to be distributed in such a way as to be
  24.  construed as "value added" in a sales transaction, such as, but not
  25.  limited to, software bundled with a modem or CD-ROM software
  26.  collections.

  28.  2. You may modify your copy or copies of BinkleyTerm or any portion of
  29.  it, and copy and distribute such modifications under the terms of
  30.  Paragraph 1 above, provided that you also do the following:

  32.      a) cause the modified files to carry prominent notices stating
  33.      that you changed the files and the date of any change;
  34.  
  35.      b) cause the executable code of such modified version to clearly
  36.      identify itself as such in the course of its normal operation;
  37.  
  38.      c) if the modified version is not a "port", but operates in the
  39.      same hardware and/or software environment as the original
  40.      distribution, make the original version equally available,
  41.      clearly identifying same as the original, unmodified version;

  43.      d) cause the whole of any work that you distribute or publish,
  44.      that in whole or in part contains or is a derivative of
  45.      BinkleyTerm or any part thereof, to be licensed at no charge to
  46.      all third parties on terms identical to those contained in this
  47.      License Agreement (except that you may choose to grant more
  48.      extensive warranty protection to some or all third parties, at
  49.      your option); and

  51.      e) send the complete source code modifications to either or both
  52.      of the Authors at one of the addresses listed below, for their
  53.      evaluation for inclusion in future releases of BinkleyTerm.
  54.      Should your source code be included in BinkleyTerm, the Authors
  55.      retain all rights for redistribution of the code as part of
  56.      BinkleyTerm and all derivative works, with appropriate credit
  57.      given to the author of the modification.

  59.      f) You may charge a distribution fee for the physical act of
  60.      transferring a copy, but no more than is necessary to recover
  61.      your actual costs incurred in the transfer, and you may at your
  62.      option offer warranty protection in exchange for a fee.

  64.  3. Mere aggregation of another unrelated program with this program (or
  65.  its derivative) on a volume of a storage or distribution medium does not
  66.  bring the other program under the scope of these terms.

  68.  4. You may copy and distribute BinkleyTerm (or a portion or derivative
  69.  of it, under Paragraph 2) in object code or executable form under the
  70.  terms of Paragraphs 1 and 2 above provided that you also do one of the
  71.  following:

  73.      a) accompany it with the complete corresponding machine-readable
  74.      source code, which must be distributed under the terms of
  75.      Paragraphs 1 and 2 above; or,
  76.  
  77.      b) accompany it with a written offer, valid for at least three
  78.      years, to give any third party free (except for a nominal
  79.      shipping charge) a complete machine-readable copy of the
  80.      corresponding source code, to be distributed under the terms of
  81.      Paragraphs 1 and 2 above; or,
  82.  
  83.      c) accompany it with the information you received as to where
  84.      the corresponding source code may be obtained.  (This
  85.      alternative is allowed only for noncommercial distribution and
  86.      only if you received the program in object code or executable
  87.      form alone.)

  89.  For an executable file, complete source code means all the source code
  90.  for all modules it contains; but, as a special exception, it need not
  91.  include source code for modules which are standard libraries that
  92.  accompany the operating system on which the executable file runs.

  94.  5. You may not copy, sublicense, distribute or transfer BinkleyTerm
  95.  except as expressly provided under this License Agreement.  Any attempt
  96.  otherwise to copy, sublicense, distribute or transfer BinkleyTerm is
  97.  void and your rights to use the program under this License agreement
  98.  shall be automatically terminated.  However, parties who have received
  99.  computer software programs from you with this License Agreement will not
  100.  have their licenses terminated so long as such parties remain in full
  101.  compliance, and notify the Authors of their intention to comply with
  102.  this Agreement.

  104.  6. If you wish to incorporate parts of BinkleyTerm into other free
  105.  programs whose distribution conditions are different, please contact
  106.  either Robert Hartman or Vincent Perriello, at the addresses listed
  107.  below.  We have not yet worked out a simple rule that can be stated
  108.  here, but we will usually permit this.  We will be guided by the two
  109.  goals of preserving the free status of all derivatives of our free
  110.  software (as it pertains to Non-Commercial use as provided by this
  111.  Agreement) and of promoting the sharing and reuse of software.

  113.  7. For the purposes of this document, "COMMERCIAL USE" is defined as
  114.  concurrent operation of the software on four or more computers or data
  115.  lines owned by the same for-profit organization. Any organization may
  116.  operate this software under the terms of this Non-Commercial Agreement
  117.  if operation is limited to three or less computers or data lines.

  120.                             NO WARRANTY
  121.  
  122.  BECAUSE BINKLEYTERM IS LICENSED FREE OF CHARGE, WE PROVIDE ABSOLUTELY NO
  123.  WARRANTY.  EXCEPT WHEN OTHERWISE STATED IN WRITING, ROBERT HARTMAN,
  124.  VINCENT PERRIELLO AND/OR OTHER PARTIES PROVIDE BINKLEYTERM "AS IS"
  125.  WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING,
  126.  BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
  127.  FITNESS FOR A PARTICULAR PURPOSE.  THE ENTIRE RISK AS TO THE QUALITY AND
  128.  PERFORMANCE OF BINKLEYTERM IS WITH YOU.  SHOULD BINKLEYTERM PROVE
  129.  DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR
  130.  CORRECTION.

  132.  IN NO EVENT WILL ROBERT HARTMAN AND VINCENT PERRIELLO BE RESPONSIBLE IN
  133.  ANY WAY FOR THE BEHAVIOR OF MODIFIED VERSIONS OF BINKLEYTERM. IN NO
  134.  EVENT WILL ROBERT HARTMAN, VINCENT PERRIELLO, AND/OR ANY OTHER PARTY WHO
  135.  MAY MODIFY AND REDISTRIBUTE BINKLEYTERM AS PERMITTED ABOVE, BE LIABLE TO
  136.  YOU FOR DAMAGES, INCLUDING ANY LOST PROFITS, LOST MONIES, OR OTHER
  137.  SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR
  138.  INABILITY TO USE (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA
  139.  BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY THIRD PARTIES OR A
  140.  FAILURE OF THE PROGRAM TO OPERATE WITH ANY OTHER PROGRAMS) BINKLEYTERM,
  141.  EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR
  142.  ANY CLAIM BY ANY OTHER PARTY.
